Terms of Service¶

Not legal advice. This document is a starting point for the managed Scribegate service at
scribegate.dev. Before a commercial launch, have it reviewed by a qualified lawyer. Self-hosted deployments are governed only by the software license (FSL-1.1-MIT), not by these terms.
These Terms of Service ("Terms") govern your use of the managed Scribegate service at scribegate.dev (the "Service"), operated by:

Referred to below as "we", "us". By creating an account or using the Service, you agree to these Terms.
1. Your account¶
- You must be at least 16 years old, or the age of digital consent in your country, whichever is higher
- You're responsible for keeping your password and API tokens confidential
- One person, one account. You may not create accounts on behalf of others or share login credentials
- You must provide a working email address so we can reach you for security notices
2. Your content¶
- You own what you write. Repositories, documents, revisions, proposals, reviews, comments, media, and templates you create are yours
- You grant us a limited licence to store, display, and transmit your content as necessary to operate the Service (render it to other authorised users, include it in backups, serve it via the Git clone transport, generate static sites on demand, etc.). This licence terminates when you delete the content or the account
- You are responsible for what you upload. You warrant that you have the right to publish the content and that it does not infringe anyone else's rights
- We don't claim ownership and won't use your content to train machine learning models
3. Acceptable use¶
You must follow the Acceptable Use Policy. In short: don't upload content that's illegal, infringing, or abusive. Don't attack the Service or other users. Don't use it as distribution infrastructure for malware, spam, or illegal content.
Violations can result in content removal, suspension, or termination, depending on severity.
4. Moderation¶
- We review content reactively on receiving reports through the in-product report feature or an email to trust@scribegate.dev
- We do not proactively scan content except as required by law
- Process and SLAs are documented in the Takedown Policy
5. Service availability¶
We aim for high availability but make no guarantees. The Service is provided "as is". We may perform maintenance, introduce breaking changes, or discontinue features. Material changes to paid features (if any) are notified in advance.
We can suspend or terminate accounts that violate these Terms, with or without notice depending on severity. For minor violations we usually send a warning first; for serious violations (illegal content, attacks on the Service) we act immediately.
6. Fees¶
The Service is currently free. If we introduce paid tiers, the pricing and payment terms will be published and your free usage (within the free tier limits) will remain available. We will not retroactively charge for services already consumed.
7. Termination¶
- You can terminate at any time by deleting your account from the settings page. Data deletion follows the Privacy Policy
- We can terminate your account for Terms violations, with notice where possible. In the event of termination for violation, we may preserve content briefly (up to 90 days) for investigation and appeal
- Clauses that by their nature should survive termination (indemnity, liability limits, data-retention-for-audit) do survive
8. Export before termination¶
If you want a copy of your content before deleting your account, use the repository export endpoint (zip of markdown) or contact trust@scribegate.dev for a full account export.
9. Intellectual property¶
Scribegate, the Scribegate name, and the scribegate.dev brand are ours. The Scribegate software source code is released under FSL-1.1-MIT. You may run, modify, and self-host the software under those terms.
10. Disclaimers and liability¶
- No warranty. The Service is provided "as is" without warranty of any kind, to the extent permitted by law
- Liability cap. Our aggregate liability for any claim arising from or related to the Service is limited to the greater of (a) fees you paid us in the 12 months before the claim, or (b) €100
- Excluded damages. We are not liable for indirect, consequential, or special damages (lost profits, lost data where backups were available, etc.)
- EU consumer rights are unaffected. Nothing in these Terms limits rights you have as a consumer under mandatory EU consumer protection law
11. Indemnity¶
You will defend and indemnify us against any third-party claim arising from (a) content you upload that violates these Terms or the Acceptable Use Policy, or (b) your violation of applicable law. We will notify you of any such claim and cooperate reasonably in the defence.
12. Governing law and disputes¶
These Terms are governed by the laws of Belgium. Disputes are subject to the exclusive jurisdiction of the courts of the judicial district of Antwerp (the competent court for Boom, Belgium).
EU consumers retain the right to bring claims in the courts of their country of residence, and can use the European Commission's Online Dispute Resolution platform.
13. Changes¶
We may update these Terms. Material changes are notified to logged-in users via the in-product notification system at least 30 days before taking effect. If you continue using the Service after a change takes effect, you accept the new Terms. If you do not accept, delete your account.
